Terms of Service

1. Who we are

EstatePic is an online photo-enhancement service for real estate professionals operated by Zakaria alaoui, trading as EstatePic ("we", "us"). By using EstatePic you enter into a contract with Zakaria alaoui. Contact: contact@estatepic.com.

2. Acceptance

By creating an account, purchasing a plan or continuing to use the service, you agree to these Terms. If you use EstatePic on behalf of an organisation, you confirm you have authority to bind it; otherwise you confirm you are of legal age.

3. The service

EstatePic uses AI to enhance property photos (light, colour, perspective, cleanup) and, in a separate labelled mode, to produce decluttering or light virtual-staging visualisations. Access is credit-based: each processed photo uses one credit, according to your plan.

4. Your account

You must provide accurate information, keep your credentials confidential and are responsible for all activity under your account.

5. Acceptable use

You must not use the service unlawfully; for fraud, spam or misleading property listings; to infringe intellectual property or privacy rights; to create deepfakes, hateful or illegal content; to interfere with security (malware, probing, scraping, jailbreaking or circumventing limits); or to reverse engineer, resell or redistribute the service.

You are responsible for how you present edited photos to buyers or tenants. Visualisations (decluttering, staging) must be disclosed as such.

6. Your content and AI outputs

You must own or have the rights to every photo you upload. You keep ownership of your uploads and of the outputs generated for you. You grant us a limited licence to host and process your content solely to provide the service.

AI outputs may contain errors. You must review every output before publishing it. Rights-holders can report infringing content to contact@estatepic.com; we will remove it where appropriate and may suspend accounts that repeatedly infringe. We may remove or restrict content, refuse outputs or suspend accounts that breach these Terms.

7. Intellectual property

We retain all rights to the EstatePic software, documentation, branding and website. We grant you a limited, non-exclusive, non-transferable right to use the service within your plan.

8. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, renewals, cancellations and refunds are governed by Paddle's Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms. Subscriptions renew automatically each month or year until cancelled; you can cancel at any time and keep access until the end of the paid period. See also our Refund Policy.

9. Service level

We aim for a reliable service but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.

10. Liability

We are not liable for indirect or consequential losses (lost profits, data or goodwill). Our total liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury where the law forbids it. You will indemnify us against claims arising from your content, unlawful use or breach of these Terms.

11. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. You may close your account at any time. After termination, your photos are deleted within 30 days.

12. General

These Terms are governed by Swiss law and disputes fall under the courts of the seller's place of residence, subject to mandatory consumer protections. You may not assign these Terms without our consent. We are not responsible for delays caused by events beyond our reasonable control. We may update these Terms and will post the new version here.
